Case Overview

In September 2024, the Baraboo School District Board of Education proposed an “Anti-Hate Speech” policy that bans any use of district-defined “hate speech.” The proposed policy would unconstitutionally restrict student speech on and off campus, even when the off-campus speech has no nexus with the school, and restrict the right of district employees to speak about matters of public concern while off-duty. 

On November 18, FIREwrote a letter calling on the board to reject or revise the proposed “Anti-Hate Speech” policy. 

In January 2025, FIRElearned the board intended to consider a revised but still unconstitutional “Anti-Hate Speech” policy. On January 27, FIREagain wrote to the board urging it to reject or further revise the policy. That evening, the board voted to send the policy back to its policy committee for further discussion.
